Unofficially, "Vijesti" found out that SDT will not say anything new in that case, that is, they will put forward the views that are already known to the public. SDT informed the Municipality of Tivat at the beginning of June that in this case there was no irregularity that a criminal offense was committed. The President of the Tivat Municipality, Siniša Kusovac, and CEO of Adriatic Marinas (AM) David Margason signed a contract on September 20th, on the basis of which the Municipality invested 5.6 million euros in compensation for the communal equipment on the construction of land by the investor who manages Porto Montenegro.
SDT has not yet responded to the question by "Vijesti" of whether there are elements of a criminal offense in the area of corruption and organized crime in this case, which they are obliged to go ex officio. They have not responded if they consider that, bearing in mind the treatment and statements of some state authorities and individuals over the past period, primarily Montenegrin President Djukanovic and Prime Minister Dusko Markovic, who put the pressure that the contract between Tivat and AM gets signed and that the acts have the elements of “encouraging a criminal offense".
At the beginning of April during the pre-presidential campaign, Djukanovic indirectly invited Tivat's leaders to complete this work, pointing out that it has a legal basis in the Arsenal's contract, which he then signed with the former owner of Porto Montenegro, Peter Munk. After the signing of the communal relief contract, the Tivat Municipality announced that it was "their obligation to accept the AM company's investments in municipal equipment and communal equipment construction, regulated by the Law on Space Planning and Construction, and that, in agreement with the Purchase Agreement of the Navy shipyard 'Sava Kovačević' whose signatories are the Government of Montenegro and AM."
Matijević filed a complaint with the Prosecution
The local parliament in Tivat in January this year, with 17 votes from DPS, formally agreed to sign a deal with Porto, but former Mayor Snezana Matijevic refused to sign a contract for months, suspicious of its legality.
"Freedom is the most important thing and I do not want to go to Spuž because of this tomorrow," said Matijevic at one of the local parliament meetings, after which her party DPS forced her to resign as mayor and brought the chairman of DPS Tivat Siniša Kusovac. The Municipality of Tivat, headed by Matijevic, submitted the documentation to SDT, and SDT found that the local parliament "proceeded in the manner and according to the procedure prescribed by the Law and the Statute of the Municipality and by the authorized body".
Kusovac claimed that the signing of the contract is a "compensation for furnishing urban construction land where the strategic investor invested money". However, this is not true, as Article 1 of the contract clearly states that Porto is released of a milestone tax on three bases which are known neither in 2007 when the construction of this complex began, nor today by the laws on the planning of space and construction of buildings.
